![]() ![]() Even if you get primary custody, she's almost certainly going to have visitation. I'm sure you realize this isn't a useful sentiment. I'm also very angry right now and would love if their mom just do happened to have a heart attack and die. It's important you don't discuss the custody case or bad-mouth their mother to them. If the judge finds otherwise, it will really hurt your case for full custody. You need to be able to tell the judge under oath that you've done everything you possibly could to get her to visit. If the 13 year old absolutely refuses, there need to be consequences like there would be for any other disobedience, e.g., grounding, loss of screen time, whatever. This means putting the 8 year old in the car even if he doesn't want to go. You tell them they have to go, because you can get in big trouble if you don't, up to and including an additional loss of time with you. ![]() What do I do when my children are in the house screaming, crying, and completely refusing to go to mom's? They hate their mom and want nothing to do with her. If the emergency custody issue is dismissed and we have to go back to 50\50 custody, what do I do when my children are in the house screaming, crying, and completely refusing to go to mom's? Do I tell mom to kick rocks? My daughter is 13 and wants me to have full custody, but my son is only 8. Problem is, neither of my children want to go and they have serious issues when mom is brought up. There's an emergency custody case open right now but my attorney thinks it's going to be dismissed because DHS said it's okay if my kids go back to their mom's. My daughter has been diagnosed with PTSD and my son has some serious anger issues. Kids are being emotionally abused at mom's and have some really bad issues from it. Basically I'm in a custody battle with ex wife, emergency custody at this time, but I'm going to talk to attorney about filling for full custody. If I sat here and typed out everything I wanted to say it would take quite a while.
